Salient Features of Constitution of Malaysia
(1) Introduction:
The federal constitution of Malaysia is supreme law of Malaysia came into force on 27 August 1957 but formal independence on 31 August. This constitution was amended in 1963 to admit Sabah, Sarawak and Singapore as additional member state of the federation. This constitution came into existence after changing needs. According to this constitution Malaysia is a federal Republic. This constitution has been amended 57 time so for. In Malaysia the parliament is bicameral. Its upper house is senate which is called Dewan-e-Negara and the lower house is house of Representative (Dewaan-e-Rakyat).
(2) Salient features of federal constitution of Malaysia:
(a) Structure:
The current constitution consists of 230 articles 13 schedule and 15 parts (chapters). This constitution was reified on 27 August 1957. However Independence Day of Malaysia celebrated on 31 August.
(b) Written and Enacted:
The federal constitution of Malaysia is in written form. It has 57 amendments up till known it was ratified on 27 August 1957. Malaysian parliament passed this constitution with mutual consensus.
(c) Federal form of government:
In Malaysia there is federal form of government. Article 71 talk about state sovereignty and state constitution, the federation is required to grantee the sovereignty of Malay Sultan in their respective state.
(d) Bicameral form of government:
In Malaysia there is bicameral parliament meaning by parliament has two houses the upper house is called Senate or Deewan-e-Negara and the lower house of Representative is called Deewan-e-Rakyat. The cabinet is head by Prime Minister.
(e) Citizenship:
In Malaysia it is mandatory to have citizenship of last 21 years old for every citizen. All the members of Malaysia gives avail registration of citizenship. Any foreign how is residential at least 10 years in Malaysia may avail Malay nationality.
(f) Fundamental Liberties:
The federal constitution of Malaysia gives protections fundamental rights and liberties. Article 5 to 13 relates to fundamental liberties. These rights protect the citizens from slavery, forced label and illegal punishments.
(g) Equality of law:
All persons are equal before the law and entitle to its equal protections. The concept of rule of law is prevailing in Malaysia article 8 of the federal constitution guarantees the rule of law for all Malay citizens.
(h) Freedom of religions:
Federal constitution of Malaysia gives protections to all religions. Article 11 provides that every person has the right to process practice his on religion. In Malaysia the majority is Muslim but freedom to carry on missionary work among non Muslim is not protected.
(i) Federal Courts:
In Malaysia the Supreme Judicial constitution is Federal courts. All the judicial powers are wasted to federal courts. Being the apex courts all the judicial powers are administered and controlled by the federal court.
(j) State Islamic law and Sharia Courts:
In federal constitution of Malaysia a separate list of Islamic laws. A Sharia court is prepared according to which criminal justice system of Sharia court is established. All the Muslims are punished according to Sharia law this is a unique example of Islamic law is Malaysia. Malay citizens are bound before law.
